MY ALLSTATE HORROR STORY

My son was in an accident with Anthony D. Decuir who ran a stop sign in front of my sons car who, being unable to stop in time to avoid the accident, ran into the side of Anthony D. Decuir’s truck (who is insured by AllState insurance). My son received neck and chest muscle strains and some bruising. Passenger in my sons car received severe head and arm injuries.
Allstate Insurance adjuster Pam Hobbs of the Baton Rouge, La. main office said she would only offer what they call the replacement cost of the car. By her office standards this is less then blue book value after she deducted what she claims as adjustments. She refuses to restore or replace the car and offered only $2230.00, which is a little over 1/3 of the value of my son’s car, as settlement. The blue book value is $4,750.00. Even when their price range that she shows on the total loss appraisal is $5,183.00 to $4,462.00 with the average being $4,703.00.
I called Allstate Insurance representative Amy Dartez who said she could not help me in the appraisal of the car and who has not helped me in any of this so far. I would like to know were justice is in our country were an insurance co. like Allstate Insurance can get away with ripping people off in the replacement of a car that their policy holder damaged. After talking to a lawyer he said it would be hard to get a fair settlement with this Co. and if I brought them to court that his cost with court fees, etc. would be higher then the value of the car. How can they get away with this???
Is there no justice to force Allstate Insurance to be fair in their settlements?????
"There is no incentive for insurance companies to do what is right, such as live up to the promises made in their policies. Tort reformers fueled by insurance money think big business and the insurance industry need to be protected against "runaway juries." It's the other way around. Big business and the insurance industry have always been able to take care of themselves. The little people need protection from them. This country was founded on the common law right of the little guy to get into court with his hired gun to fight the oppressor, be it big government or big business. Take that away and we have nothing left. Look around. It's being whittled away, bit by bit, caps on damages here, restrictions on jury trials there. It won't end until we recognize the enemy and join together to take a stand against them. It will take the little people to do this together".
